New York State Tax Department Seeks New Taxpayer Advocate

Advocate Assists Taxpayers With Undue Tax Burdens, Promotes Fair Administration of the State Tax Code

ALBANY, NY (02/22/2012)(readMedia)– The New York State Department of Taxation and Finance announced today that it is seeking a new Taxpayer Rights Advocate. The former Advocate, Jack Trachtenberg, the first Deputy Commissioner to serve in the role, has left the position after a successful two-year tenure to pursue an opportunity in the private sector. The Office of the Taxpayer Rights Advocate (OTRA), modeled on the IRS’ National Tax Advocate acts as a mediator between the Tax Department and taxpayers, and is tasked with directly assisting taxpayers when issues aren’t resolved through normal Department channels.

“We are committed to finding the right person to take on this critical role,” said New York State Tax Commissioner Thomas H. Mattox. In just over two years, the Advocate’s Office went from being a concept to an Office that has helped more than 2,000 taxpayers receive much needed relief and recommended tax reform legislation that was signed into law by Governor Andrew M. Cuomo. I thank Jack for his hard work launching the Advocate’s Office and making it such an effective function in a relatively short period of time.”

Further, in 2011 alone, the Office resolved 1,600 cases mediating on behalf of taxpayers and ensuring timely problem resolution with sixty five percent of those cases receiving full or partial relief. OTRA also successfully promoted legislation that created a twenty year statute of limitations on tax liability and a new hardship settlement provision to assist taxpayers experiencing undue economic hardship.

The staff of the Office of the Taxpayer Advocate will continue its important work on behalf of taxpayers while the Department conducts a search for a new Advocate.

Applicants for the taxpayer advocate position must have a bachelor’s degree. Preferred qualifications include a law degree, certification as a public accountant (CPA) or extensive experience in tax administration or tax arbitration.
